1. How to Enter: The Next Food Network Star Las Vegas Sweepstakes (the “Sweepstakes”) begins at 12:00 a.m. (Eastern Time (“ET”)) on 5/24/08 and ends at 11:59 ET on 7/6/08 (the “Sweepstakes Period”). Two Ways to Enter: 1) Online Entry: Visit www.foodnetworksweeps.com (the “Web Site”), fill in the online entry form, submit it in accordance with the on-screen directions during the Sweepstakes Period, and you will be entered; or 2) Text Message: Text STAR to 99134 to be entered into the Sweepstakes. This service is available on the following U.S. carriers: AT&T, Sprint, Verizon Wireless, Virgin Mobile, T-Mobile, Nextel, Boost, CellularOne Dobson. Standard/other messaging rates apply, please check your mobile service rate plan. For help text HELP to 99134. To opt out of receiving future text messages from Sponsor, please reply STOP to 99134. Limit one (1) entry per person, per email address and per wireless phone number per day for the entire Sweepstakes Period, regardless of method of entry. Entries received from the same person or email address or wireless phone number on any given day after the first entry received from that person or email address or wireless phone number on that day will be void. Entries must be received by 11:59 p.m. ET on 7/6/08 to be eligible. Entries generated by script, macro or other automated means will be void. All entries submitted become the sole property of Sponsor and will not be acknowledged or returned.
2. Eligibility: To enter the Sweepstakes you must be a legal resident of the 50 United States or the District of Columbia and be 21 years of age or older. Sweepstakes is void in Puerto Rico, other U.S. territories, possessions and commonwealths, and where restricted or prohibited by law. The Sweepstakes, and any web site pages and advertisements relating thereto, is intended for viewing only within the United States. You are not authorized to participate in the Sweepstakes if you are not located within the United States. Employees of Television Food Network, G.P. (“Sponsor”), KitchenAid, Desert Palace, Inc., Southwest Airlines, and Haley Miranda Group (“Sweepstakes Administrator”), and their respective affiliated companies, parents, subsidiaries and advertising and promotion agencies (collectively, “Sweepstakes Entities”), and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of their households, whether or not related, are ineligible to participate in this Sweepstakes.
3. Drawing and Notification: Potential Grand Prize Winner will be selected from all eligible entries received in a random drawing held on or about 7/14/08 by Sweepstakes Administrator, an independent judging organization whose decisions are final and binding in all respects. Odds of winning the Grand Prize depends upon the number of eligible entries received. The potential Grand Prize Winner will be notified by phone, email and/or mail. If potential Grand Prize Winner cannot be reached within ten (10) days from the date of the first notification attempt, he/she shall be disqualified and, at Sponsor’s discretion, an alternate Winner will be selected.
Grand Prize (1): A trip for two (2) to Caesars Palace in Las Vegas, Nevada on dates to be determined by Sponsor. Trip includes: roundtrip coach air transportation from a major U.S. gateway nearest winner’s residence, as determined by Sponsor, to Las Vegas McCarran Airport; standard hotel accommodations (one (1) room, double occupancy) for three (3) days and two (2) nights in Caesars Palace Las Vegas (or comparable hotel, as determined by Sponsor); a $200.00 Gift Certificate to Bobby Flay’s Mesa Grill Caesars Palace; two (2) $50 Gift Certificates for a Roman Rituals experience in Qua Baths & Spa at Caesars Palace; a KitchenAid Artisan Series Stand Mixer and $1,000.00 (awarded as a check) for the winner only. If winner resides within a 100-mile radius of destination, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for the difference in prize value. Travel must be made through Sponsor’s agent, on Southwest Airlines and/or a carrier of Sponsor’s choice fourteen (14) days prior to travel. Tickets issued by Southwest Airlines will bear the date of issue and the date of expiration. Expiration dates will not be extended, and tickets will not be refundable or redeemable for cash or credit at any time, nor will tickets be replaced if lost or stolen. Tickets may not be sold to a third party. Tickets valid on Southwest-operated, published, scheduled service only. If the winner does not live in a city served by Southwest Airlines, the sponsor is responsible for transportation on the carrier of the Sponsor's choice. No substitutions are allowed. Trip must be taken by 6/30/09 or prize will be forfeited and Sponsor will have no further obligation to winner. Winner and guest must travel together on the same itinerary. Guest must be 21 years of age or older and must sign a liability/publicity release prior to issuance of travel documents. Winner and guest are responsible for obtaining all required travel documents prior to travel. Accommodations, air-transportation and activities are subject to availability. Certain travel restrictions [and black out dates] may apply. Gift Certificates are subject to terms and conditions as specified by issuers. Total Approximate Retail Value of Grand Prize: $3,850.00. Actual value may vary based on winner’s residence.
All costs, fees, and expenses associated with the acceptance and use of the prize not specifically specified herein as being provided are the sole responsibility of the Grand Prize Winner, including any transportation costs, additional meals, gratuities and souvenirs. All federal, state, and local taxes are the Grand Prize Winner’s responsibility. The Grand Prize Winner will be issued a 1099 tax form for the actual value of the Grand Prize. All prize details are at the sole discretion of the Sponsor. Sponsor reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value, at its sole discretion. The Grand Prize cannot be transferred or substituted or redeemed for cash (if non-cash prize) except at Sponsor’s sole discretion.
5. Prize Conditions: If Sponsor is unable to contact the potential Grand Prize Winner within seven (7) days of the initial contact attempt, if the prize notification is returned as undeliverable, if potential Grand Prize Winner fails to complete and return all requested forms within ten (10) days of date of issuance, if potential Grand Prize Winner is found to be ineligible, or if he/she does not comply with the Official Rules, or if the potential Grand Prize Winner fails to comply with any of the requirements set forth herein, his/her prize will be forfeited and, at Sponsor’s discretion, an alternate winner shall be selected. Potential Grand Prize Winner will be required to execute an Affidavit of Eligibility, a Liability Release and a Publicity Release (where legal) (“Affidavit/Release”). Such document must be returned within ten (10) days of issuance or prize will be forfeited and Sponsor will have no further obligation to such Grand Prize Winner. Except where prohibited by law, the Grand Prize Winner’s entry and acceptance of the Grand Prize constitutes permission for the Sweepstakes Entities and their respective designees to use said Grand Prize Winner’s name, photograph, likeness, statements, biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, now or hereafter devised, in perpetuity, without further compensation, notification or permission.
6. Sweepstakes Conditions: This Sweepstakes is subject to all applicable federal, state and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and Sweepstakes Administrator, which shall be final and binding and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Grand Prize Winner and entrants also agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities and each of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) from and against any claims, damages or liability due to any injuries, damages or losses to any person (including personal injury or death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the Grand Prize (including any travel/activity related thereto) or participation in any Sweepstakes-related activity or participation in this Sweepstakes, or any claims based on rights of publicity, rights of privacy and/or merchandise delivery.
7. Limitations of Liability: In case of dispute as to the identity of any online entrant, entry will be declared made by the authorized account holder of the email address submitted at time of entry provided he/she is eligible according to these rules. “Authorized Account Holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. . In the event of a dispute regarding entries received from multiple users having the same wireless phone number, the authorized subscriber of the wireless phone number at the time of entry will be deemed to be the entrant and must comply with these rules. Authorized account subscriber is the natural person who is assigned the wireless phone number by wireless service provider responsible for assigning that wireless phone number. Potential Grand Prize Winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the email address or wireless phone number associated with the winning entry. Released Parties are not responsible for late, lost, damaged, misdirected, incomplete, delayed, undeliverable, garbled destroyed or inaccurate entries or text messages due to system errors or failures, or faulty transmissions or other telecommunications malfunctions and/or entries not received resulting from any hardware or software failures of any kind, lost or unavailable network, cable, satellite, Internet Service Provider or other connections, or failed, incomplete or garbled computer, wireless service provider or telephone transmissions, typographical or system errors and failures, or faulty transmissions, or for any errors, problems or malfunctions whether technical, computer, network, telephonic, mechanical, typographical, printing, human or otherwise, including any errors, problems or malfunctions which may occur in connection with the administration of the Sweepstakes, the processing of entries or text messages, the announcement of the prize or in any Sweepstakes-related materials. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning the Grand Prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives and void all associated entries. If for any reason this Sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes which corrupt in any way or affect the administration, security, fairness, integrity, fulfillment or proper conduct of the Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and, in the event of cancellation or termination, select the winner by randomly drawing from those eligible, non-suspect entries received up to the cancellation/termination date. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
8. Rules/Winner’s Name: To receive the Winner’s name or an additional copy of these Official Rules, send a self-addressed, stamped envelope to: The Next Food Network Star Las Vegas Sweepstakes, c/o Haley Miranda Group \8654 Washington Blvd., Culver City, CA 90232. Please specify “Rules” or “Winner Name.” Winner’s Name will be available after 7/28/08. Requests received after 8/25/08 will not be honored. The rules are also available on the Web Site.
